The Digital Images in question are sent at the Client’s
request.
2 The Client is granted a non-exclusive
license, in accordance with the Standard BAPLA Terms and Conditions,
to use the Digital Images strictly for the purpose Authorised
- and is limited to the following rights (unless otherwise agreed
in writing):
LIMITATION OF USE
a) Images cannot be released nor rights to
reproduction granted until all reproduction fees are agreed
and paid in full and within the terms specified on thes invoice.
b) The Digital Images cannot be altered or
edited in any way without written agreement from Food Features.
c) The Client must destroy the Digital Image
files on the termination date of this agreement and remove/destroy
all copies of such files from use.
d) The Digital Images cannot be copied, duplicated
or loaned to a third party without written agreement from Food
Features.
e) The Digital Images can only be used for
the Authorised print/publication/media as agreed with Food Features.
Use in any other product or service is not included in this
Agreement and will incur an additional license fee and an immediate
termination of this agreement.
3 The Digital Images are supplied on LOAN
and no property or copyright in any Digital Image shall pass
to the Client whether on it's submission or in the Suppliers
grant of reproduction rights thereof.
COPYRIGHT AGREEMENT
4 The Client agrees to ensure that each/any
reproduction of the Digital Images created, as is necessary
as part of this Agreement, shall contain as part of the readable
Digital Image file, a copyright notice in the form of ©
Food Features 01483 810840 unless otherwise agreed in writing.

5The Client agrees that each
reproduction of an Image will be credited to Food Features,
and all images for use on the Internet/Webb will incorporate
a Credit or copyright notice to Food Features whenever any Digital
Image is reproduced.
UNAUTHORISED USAGE
6 In the event the Client utilizes an Image
other than for the usage indicated on the Invoice, within the
terms of this agreement or according to the fee calculated in
good faith from the information provided by the Client, Food
Features shall have the right to sue for copyright infringement,
plus Legal fees and all associated costs.
7 Food Features and the Client agree to notify
each other of any infringement by End Users of these Digital
Images which may come to their attention and provide each other
with any information that may be of assistance in any resultant
litigation.
8 Food Features Digital Images are protected
under the copyright law of England and Wales and the parties
agree to accept the exclusive jurisdiction of the Courts of
England. It is a criminal offence to make for sale or to hire
or distribute an infringing copy of any part of this work.
